Warrant of arrest against Francesco Marconati cancelled

The businessman's lawyer Chamu Chingwegangata produced documentary evidence proving his client' presence at the High Court, leading Magistrate Ndirowei to logically cancel the warrant.

Harare- REGIONAL Magistrate Donald Ndirowei has cancelled the warrant of arrest issued against Eagle Italian Shoes director Francesco Marconati, citing that his failure to attend court was not willful, Express Mail Zim can report.

Marconati’s lawyer, Chamu Chingwegangata, argued that his client was needed at the High Court for another matter, contrary to the State’s claims that he was dismissed before lunch.

The warrant was issued after prosecutor Anesu Chirenje presented an affidavit stating that Marconati’s case was dealt with at the High Court and he was no longer needed.

However, Chingwegangata produced documentary evidence proving Marconati’s presence at the High Court, leading Magistrate Ndirowei to logically cancel the warrant.

The matter has been rolled over to Friday for a pre-sentence hearing.

Marconati was convicted of fraud and forgery last week for removing his business partner, Li Song, from the company’s directorship through ‘falsified’ documents.
