Pambukanis lose Crowhill Farm land battle

Harare- THE Supreme Court has barred embattled land development entrepreneurs Florence and Felix Pambukani from interfering with Crowhill Farm confining them to their single stand measuring only 1,200 square metres, in a ruling which closes the land ownership wrangle, Express Mail Zim can report.

The latest Supreme Court ruling also pours cold water on the Pambukanis’ attempts to wrestle the 724 0475 hectares of land from Zanu PF stalwart and top banker Ozias Bvute.

The ruling also confirms Bvute as the rightful owner of the 724 0475 hectares of land as stated by a November 2021 High Court ruling by Justice Chinamora.

Aggrieved by the Justice Webster Chinamora ruling, Florence Pambukani and husband Felix then appealed to the Supreme Court (CASE NO. SC 440/21) arguing that the High Court had erred in its judgment.

Prominent lawyer, Tinashe Tanyanyiwa represented Crowhill Farm in the matter while Advocate Agyver Sawunyama represented the Pambukanis.

In court papers, Tanyanyiwa told the Supreme Court that the couple had failed to impeach the judgment of Justice Chinamora and prayed the Supreme Court to throw out the Pambukanis’ appeal.

Facts of the matter are that, in 2021 Pambukani started working on roads and claiming ownership of Crowhill in areas where Bvute argued that she had no title. According to Bvute, Pambukani’s interest is share 702, which is just a stand among many other stands in Crowhill.

Following these developments, Bvute then approached the High Court on an urgent basis arguing that Pambukani had dispelled him of his land.

Justice Chinamora subsequently granted Bvute a spoliation order, which ordered the Pambukani couple to limit it’s activities to stand 702 only and not to interfere with any other property or land in Crowhill Farm.

Not happy with the High Court decision, Pambukani then approached the Supreme Court.

However, in a ruling handed down on July 3, the Supreme Court dealt Pambukani a heavy blow and dismissed her appeal.

The ruling means that Pambukani has no legal authority to deal, dispose any piece of land because she does not own Crowhill at law.
