Human rights defender Kudzanai Mashumba laments over unfair ruling in assault case
Harare- HUMAN rights defender Kudzanai Mashumba has castigated the selective application of the law.
Mashumba made reference to case presided over by Magistrate Chibanda case number 11344 State vs Yvvone Musarurwa.
She wrote a letter of complaint to prosecutor- general Loice Matanda Moyo dated November 21.

Dear Madam
I refer to the matter above.
2.I reported a case of public violence sometimes in November 2021,where Yvonne Musarurwa and others storm in my conference room and start assaulting and call off my presser at media centre,66 Jason Moyo ,Harare.
3.Investigation were done by police and the docket was handed over to court for prosecution .
4.Trial couldn’t start since 2021 untill 2023 because Yvonne Musarurwa was always absent from attending court and she was issued more than 5 warrant of arrest.I was not happy over this because witness and I were always in court and we used our previous time and money but the Magistrate was always cancelling the warrant of arrest.
5.Yvonne Musarurwa was convicted and only sentenced to 100us a lesser sentence which I presume.She wasted court time for two yrs knowing that she was guilty,She also wasted our time for two yrs,that money ,she was fined is not equal to our transport money when we were coming to court
6.I was badly injured on my right rib and the medical affidavit was produced before the courts and even the defense didn’t object.
7.I wrote a letter to the Provincial Pubic Prosecutor Mr Mutambira raising my issue.He promised to come to me in 7 days but nothing materialized.
I am praying for a review of the sentence and be given custodial sentenced.Yvonne Musarurwa was once being convicted of murder of a police officer in Glen View but she was to be pardoned by President.
