Biti assault case: High Court defers judgement to tomorrow
Harare- THE CCC vice president assault case has Monday taken a new twist as High Court judge Justice Rodgers Manyangadze has deffered the judgement to his application to be reffered to the Concourt, Express Mail Zim can report.
Biti is facing a charge of assaulting Russian businesswoman and investor Tatiana Aleshina at the Harare Magistrate’s court in 2020.
He made a futile attempt to have his case reffered to the Concourt at the lower court and proceeded to seek the same prayer at the High Court.
Manyangadze had then set March 20 as his judgement day .
In his current application,Biti argues that challenged Harare Magistrate Vongai Muchuchuti- Guwiro ‘s determination that dismissed his application for refferal to the Concourt saying his application was pregnant with merit to be reffered to the apex Court.
He further prayed for the recusal of the magistrate with sensational claims that she was biased.
The State, represented by Michael Reza, opposed the application and argued that it was vexatious and frivolous.
Reza further argued that Biti made the application in a deliberate ploy to delay two years long proceedings and stall progress.
